Terms and Conditions

OziHQ Delivery Platform

These Terms and Conditions (the "Terms") govern your access to and use of the OziHQ Delivery Platform (the "Platform"), owned and operated by Three Brothers Limited, a company incorporated under the laws of the Federal Republic of Nigeria ("Three Brothers Limited", "OziHQ", "we", "us", or "our"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please discontinue use.

1. About OziHQ

OziHQ is an online platform and mobile application that enables Users to request pickup and delivery services. Delivery Services are provided and fulfilled by Three Brothers Limited using its internal operations and engaged delivery riders.

2. Definitions
  • Platform means the OziHQ mobile application, website, and all related systems.
  • User means any individual or business that accesses or uses the Platform.
  • Sender means a User requesting a delivery.
  • Vendor means a User requesting deliveries as part of a business operation.
  • Rider means a delivery rider engaged by Three Brothers Limited to carry out deliveries.
  • Delivery Services means the pickup, transportation, and delivery of items by Three Brothers Limited.
  • Order means a delivery request placed through the Platform.
3. Scope of Services
  • OziHQ enables Users to place delivery Orders through the Platform.
  • Upon acceptance of an Order, Three Brothers Limited agrees to provide the requested Delivery Services.
  • Delivery Services are executed by Riders acting under the direction and responsibility of Three Brothers Limited.
  • A binding contract for Delivery Services is formed between the User and Three Brothers Limited when an Order is confirmed.
4. Account Registration and Eligibility
  • Users must be at least 18 years old to use the Platform.
  • All information provided during registration must be accurate and up to date.
  • Three Brothers Limited reserves the right to verify user information and request additional documentation where necessary.
  • The Company may suspend or terminate accounts that provide false, misleading, or incomplete information.
5. User Responsibilities
  • Provide correct pickup and delivery details.
  • Ensure that items are lawful and safely packaged.
  • Promptly respond to communications relating to an Order.
  • Comply with all applicable laws and regulations.

Users are solely responsible for the contents of items submitted for delivery.

6. Prohibited Items

The following items may not be sent through OziHQ:

  • Cash, negotiable instruments, or securities.
  • Illegal or controlled substances.
  • Firearms, weapons, or ammunition.
  • Explosives or hazardous materials.
  • Stolen, counterfeit, or unlawful goods.
  • Any item prohibited under Nigerian law.

Three Brothers Limited reserves the right to inspect, refuse, cancel, or report Orders involving prohibited items.

7. Delivery Process
  • Orders are placed through the Platform and assigned to a Rider by Three Brothers Limited.
  • Availability, delivery times, and coverage may vary by location and demand. Estimated delivery times are indicative and may vary due to traffic, weather, security issues, or other factors.
  • Delivery confirmation may include OTP verification, digital signature, photograph, or other electronic confirmation.
  • If delivery fails due to incorrect information, recipient unavailability, or User fault, additional charges may apply.
8. Fees and Payments
  • All delivery fees are determined by Three Brothers Limited and displayed before Order confirmation.
  • Payments must be made through approved payment methods on the Platform.
  • Fees may include delivery charges, service fees, or other applicable costs.
  • You are responsible for all applicable fees and taxes.
  • Refunds, where applicable, shall be processed in line with OziHQ's refund and cancellation policy.
9. Cancellations
  • Orders cancelled before pickup may not attract any charges.
  • Orders cancelled after pickup may attract a cancellation fee reflecting costs already incurred.
  • Three Brothers Limited may cancel Orders for safety, regulatory, or operational reasons without liability.
10. Riders and Delivery Execution
  • Riders engaged through OziHQ act on behalf of Three Brothers Limited.
  • Three Brothers Limited retains responsibility for delivery execution in accordance with these Terms.
  • Riders are required to comply with operational, safety, and traffic regulations.
11. Liability, Declared Value, and Disclaimers

Three Brothers Limited shall exercise reasonable care in providing Delivery Services. Users are encouraged to declare the value of items prior to delivery.

  • Except as required by law, liability for loss or damage is limited to the declared value of the item or the amount paid for the delivery (whichever is lower), subject to any maximum liability cap communicated on the Platform.
  • We are not liable for loss caused by improper packaging, delays beyond our reasonable control, or items whose nature or value was misstated or not disclosed.
  • To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, or consequential damages.
  • The Services are provided "as is" and "as available" without warranties of any kind, and we do not guarantee uninterrupted or error-free operation.
  • Insurance is not provided unless expressly stated.
12. Indemnity

Users agree to indemnify and hold harmless Three Brothers Limited from any claims, damages, losses, or expenses arising from:

  • Breach of these Terms.
  • Delivery of prohibited or unlawful items.
  • False declarations or misrepresentation of item contents.
13. Ratings and Communications
  • Users may submit feedback or ratings. Three Brothers Limited reserves the right to remove content that is abusive, false, or unlawful.
  • By using the Platform, Users consent to receive transactional communications related to Orders.
  • We may send service-related notifications by email, SMS, or in-app messages. Marketing preferences can be managed through account settings where available.
14. Data Protection
  • Personal data is collected and processed in accordance with the Nigeria Data Protection Regulation (NDPR).
  • User data may be shared with Riders strictly for delivery purposes.
  • Further details are contained in the Privacy Policy.
15. Intellectual Property

All intellectual property relating to OziHQ, including software, trademarks, designs, and content, belongs to Three Brothers Limited or its licensors. Users are granted a limited, non-exclusive right to use the Platform for its intended purpose. You may not copy, modify, or distribute any part of the Platform without prior written consent.

16. Suspension and Termination

Three Brothers Limited may suspend or terminate a User's access to the Platform where:

  • These Terms are breached.
  • Fraud or misuse is detected.
  • Required by law or regulatory authorities.
17. Amendments

Three Brothers Limited may revise these Terms from time to time. Updated Terms will be published on the Platform and take effect upon publication.

18. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the Federal Republic of Nigeria. Any dispute shall be resolved by Nigerian courts, or through alternative dispute resolution in Lagos, at the option of Three Brothers Limited.
